George Hepburne Scott has been instructed by Magdalena Motyl of Bark & Co to represent M.P., whose extradition to Poland is sought in connection with a murder alleged to have occurred in 1994.

M.P. denies the allegation and opposes extradition. He has lived in the United Kingdom for approximately 20 years.

The case concerns an accusation warrant issued by a Polish judicial authority in April 2026, more than three decades after the alleged events.

Extradition to Poland and the passage of time

The proceedings raise important questions about the consequences of seeking extradition so long after an alleged offence.

The defence challenges identified in the case include whether extradition would be unjust or oppressive by reason of the passage of time under section 14 of the Extradition Act 2003.

The case also raises questions concerning the purpose of the warrant and whether the necessary prosecution decisions have been taken, together with consideration of M.P.’s established private and family life in the United Kingdom.

A complex Polish extradition defence

Cases involving historic allegations require careful examination of the chronology, the procedural position in the requesting state and the grounds for challenging extradition.

The extradition court must determine whether the legal requirements for extradition are satisfied and whether any applicable statutory bar or human rights protection prevents surrender.

George will represent M.P. in contesting the Polish extradition request. The proceedings remain ongoing.
