Australian Extradition Appeal: George Hepburne Scott Instructed in A$1.2 Million Case
George Hepburne Scott, specialist extradition barrister and Head of Extradition at Church Court Chambers, has been instructed to advise on and pursue an appeal in the case of S.B., whose extradition is sought by the Government of Australia.

The case concerns 31 alleged offences of fraud, theft and related offending, involving approximately A$1.2 million. The allegations relate to conduct between 2005 and 2009, including the alleged misuse of investors’ funds and false representations in loan applications.
The instruction draws on George’s extensive experience defending complex and high-profile international extradition cases, including proceedings under Part 2 of the Extradition Act 2003.
Complex Australian extradition proceedings
Following a contested extradition hearing at Westminster Magistrates’ Court, the court rejected the objections to extradition and sent the case to the Secretary of State for a decision.
The proceedings raised several substantial issues:
Dual criminality and territorial jurisdiction: whether the alleged conduct satisfies the statutory requirements for extradition offences, including the treatment of conduct connected with more than one country.
Passage of time: the significance of the lengthy period since the alleged offending and whether extradition would be unjust or oppressive.
Prison conditions and Article 3: the assessment of detention conditions in Western Australia alongside the requested person’s individual medical needs.
Physical and mental health: the treatment of expert medical evidence and the protection afforded by section 91 of the Extradition Act 2003.
Private and family life: the impact of extradition and the balancing exercise required under Article 8.
George has now been instructed at the appeal stage to examine the judgment and evidence and develop the available grounds of challenge.
Specialist expertise in Part 2 extradition appeals
Part 2 extradition cases can require detailed analysis of overseas criminal allegations, territorial jurisdiction, statutory bars and human rights protections. Where medical evidence and foreign prison conditions are also involved, the relationship between these issues demands particularly careful scrutiny.
George’s practice includes complex and high-profile extradition proceedings involving serious financial allegations and requests from the United States, India and other international jurisdictions.
As Head of Extradition at Church Court Chambers, he brings extensive experience in contested extradition hearings and High Court appeals, combining detailed legal analysis with focused written and oral advocacy.
This Australian extradition instruction draws directly on that expertise. The review will consider the court’s application of the statutory tests, its treatment of the evidence and the reasoning supporting its conclusions.
